Participation Waiver & Release Agreement

As a Summit workshop attendee, I represent and warrant that I am physically fit and I have no medical condition(s), which would prevent my participation in the hands-on demonstrations and labs offered by Summit during the workshop, should hands-on labs be offered and I choose to participate. I understand lab participation is optional and not a requirement of course completion.

By participating in the workshop labs, I agree to assume full responsibility for any risks, injuries, damages, seen or unforeseen, whether caused by me or by any other person, which I may incur as a result of participation. I knowingly, voluntarily and expressly waive any claim, and indemnify and hold Summit and any other attendees, harmless against any injuries or damages that I may sustain as a result of participation and/or use of any equipment provided by Summit, the property, or any attendee. I also understand workshop content is not intended for use by participants outside of the regulatory scope of practice of their license(s).

I acknowledge that I am responsible for knowing what lies within and without my professional scope of practice.

Video & Audio Recording Notice

Summit may, at its sole discretion, record all or part of this course.

By entering the event premises, you consent to photography, audio recording, video recording, interviews and its/their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, or any other purpose by Summit Professional Education and its affiliates and representatives.

You also waive all rights you may have to any claims for payment or royalties in connection with any exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by Summit or the person or entity designated to do so by Summit.

Governing Law and Jurisdiction

This Agreement and its subject matter have substantial contacts with the State of Tennessee and shall be governed by and construed in accordance with the internal laws of the State of Tennessee without giving effect to any choice or conflict of law provision or rule (whether of the State of Tennessee or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of Tennessee. I agree that I will not commence any action, litigation or proceeding of any kind whatsoever against the Company in any forum other than a court of competent jurisdiction sitting in Davidson or Williamson County, Tennessee, or in the Federal District Court having jurisdiction over such Counties, and I submit to the exclusive jurisdiction of such courts regarding any matter related to this Agreement.
